Article 32.10: Non-Market Country FTA

第32.10条:非市场国家自由贸易协定

1. At least 3 months prior to commencingnegotiations a Party shall inform the other Parties of its intention tocommence free trade agreement negotiations with a non-market country. Forpurposes of this Article a non-market country is a country that on the date ofsignature of this agreement at least one Party has determined to be anon-market economy for purposes of its trade remedy laws and is a country withwhich no Party has a free trade agreement.

在开始谈判至少3个月前，一方应将其与非市场国家开始自由贸易协定谈判的意向通知另一方。就本条款而言，所谓的“非市场国家”是指，在从协议签署之日起，至少有一方遵循贸易救济规则将其视为“非市场经济体”，或者任何一方都没有与其签署自由贸易协定。

2. Upon request the Party shall provide asmuch information as possible regarding the objectives for those negotiations.

应要求，缔约方应提供关于这些谈判目标的尽可能多的资料。

3. As early as possible and no later than30 days before the date of signature that Party shall provide the otherParties with an opportunity to review the full text of the agreement includingany annexes and side instruments in order for the Parties to be able to reviewthe agreement and assess its potential impact on this Agreement. If the Partyinvolved requests that the text be treated as confidential the other Partiesshall maintain the confidentiality of the text.

尽可能早地，且不迟于签署日期前30天，签约方应为其它各方提供一个机会来审查协议的全文（包括任何附件和其他文件），以方便其它各方能够审查该协议和评估其潜在的影响。对于当事人要求保密的条款，其他当事人应当替其保密。

4. Entry by any Party into a free tradeagreement with a non-market country shall allow the other Parties to terminatethis Agreement on six-month notice and replace this Agreement with an agreementas between them (bilateral agreement).

任何一方在与非市场国家签订自由贸易协定时，应允许其他方在接到通知六个月后终止本协定，并以双方之间的协定（双边协定）取代本协定（USMCA是一个区域协定/三边协定）。

5. The bilateral agreement shall becomprised of all the provisions of this Agreement except those provisions therelevant Parties decide are not applicable as between them.

双边协议应包括本协议的所有条款，但有关各方决定的不适用于双方之间的条款除外。

6. The relevant Parties shall utilize thesix-month notice period to review the Agreement and determine whether anyamendments should be made in order to ensure the proper operation of thebilateral agreement.

有关各方应利用6个月的通知期对协议进行审查，并确定是否应做出任何修改，以确保双边协议的正常运行。

7. The bilateral agreement enter into force60 days after the date on which the parties to the bilateral agreement havenotified each other that they have completed their respective applicable legalprocedures.

双边协议自协议各方通知对方已完成各自适用的法律程序之日起60天后生效。
